Information blocks

The entry of an information block in the civil register requires that you submit an application to the Citizens' Registration Office. You can submit an application if interests worthy of protection (e.g. life, health and personal freedom) are at risk and you currently live in Dresden.

The registration, passport and ID card department of the Citizens' Registration Office is responsible for checking and deciding on this application (for more information, see Contact). You must appear in person (obligation to cooperate in accordance with Section 25 of the Federal Registration Act). Please make an appointment for this.

In order to ensure that a decision can be made quickly on your request for information blocking, please note the following

The application for an information block should be made in connection with the first registration or re-registration in accordance with Section 23 (1) BMG in Dresden after moving into a dwelling if, in your opinion, there is a risk to you and any relatives moving in with you.

• When registering/renewing, the housing provider certificate must be presented in accordance with Section 19 BMG. The children moving in with you must be present in person at the time of registration.
• The presentation of identity documents is required. (e.g. federal ID card, passport, child ID card(s), passport or passport replacement documents).
• If different arrangements have already been made regarding custody of accompanying minor children, please present them at the time of registration (legally effective decisions of the family court).
• If another registration office (previous municipality of the main or only residence or municipality of the secondary residence) has already set up an information block, please submit this confirmation when submitting the application for an information block to the Dresden registration office.
• Please fill out the application for information blocking completely and sign it. The signature(s) of all adult family members is required.
• One application form can be used for a family / household members with the same name.
• It is only necessary to apply for information blocking for the boyfriend/girlfriend or the cohabiting partner if there is a family relationship due to shared children. In the justification, reference must be made to the actual person concerned (applicant) and the partner must also sign the application.
• To make the application credible, a detailed statement of reasons and suitable evidence (e.g. criminal charges, injunctions under the Protection of Violence Act, etc.) are required. The mere assertion that one is endangered is not sufficient.
• Your cooperation in accordance with Section 25 of the Federal Registration Act is essential. Since only you can provide exact information about your personal emergency situation/personal danger to which you are/were exposed. The personal application for the information block at our registration office is required.
• In special cases, a block on information can only be considered if no data on your person and/or the family members living in the household is public and accessible to anyone. This applies, among other things, to personal details in telephone directories and publications (e.g. flyers and advertisements for main, secondary or honorary activities), entries on Internet platforms and forums, and personal websites on the Internet that contain address data or allow conclusions to be drawn about them.

If there are facts which justify the assumption that the person concerned or another person may be endangered in life, health, personal freedom or similar interests worthy of protection by information from the population register, the registration authority must enter a block on information in the population register on request.

The blocking of information for official reasons, in particular due to a professional activity in a security-sensitive area (e.g. police, judiciary, armed forces, etc.), is only established in rare exceptional cases at the request of the person concerned and the endangerment justification by the employers in the civil register. For this purpose, the danger threshold, which requires the existence of a serious reason (see BVerwG, verdict of June 21, 2006 - 6 C 5.05 - BVerwGE 126, 140 marginal no. 17 and verdict BVerwG 6 B 49.16 of February 14, 2017), must be exceeded solely by the typical occupational risks to which the affected occupational group is exposed. This requires sufficiently dense factual findings from which the existence of a danger for all members of this occupational group results in the abstract. This is because the danger threshold is no lower in the case of an abstract danger than in the case of an individual prognosis of a concrete danger.

 In order to justify the entry of an information block, facts must exist that justify the assumption that the person concerned or another person, in particular close relatives, may be endangered in terms of life, health, personal freedom or similar interests worthy of protection by the regulation of information from the population register. The facts are to be made credible by the applicant. A block on the regulation of information may be considered above all in the case of persons whose personal safety is to be regarded as endangered on the basis of specific incidents. If the reasons for a dangerous situation originate from the official area of the person concerned, the applicants must regularly have this confirmed by a certificate from the responsible head of department or the superior department. The reasons for the specific threat to the person concerned must be explained as precisely as possible. Evidence that the person is employed by a judicial or security authority, for example, or a general confirmation of risk is not sufficient to establish that the risk is service-related.

Give sufficient and plausible reasons for your request. Make it clear why the reasons you have given are to be regarded as so serious that they could justify the assumption that you or another person (family members living in the household) could be endangered in terms of life, health, personal freedom or similar interests worthy of protection by the regulation of information from the civil register. If the information block is directed against a specific person, this person must be named and, if necessary, the address must be given. If there is not enough space on the application to state the reasons, please attach an informal sheet.

A mere assertion that one is at risk is not sufficient. Suitable evidence must be submitted to substantiate the claim. This can be, for example, criminal charges at police stations, stalking protocols, verdicts, orders according to the Protection Against Violence Act, attestations, letters of threat, evidence of already approved information blocks at removal - or further residence municipalities, decisions of the family court on custody.

The information block is limited to two years from the date of application. It can be extended upon application or ex officio. The person concerned must be informed before the freeze is lifted, insofar as he or she can be reached.

The information block applies to the main and secondary residence, as well as to the last registration office before moving to Dresden (re-registration dwelling).

The application for registration of an information block should be submitted to the citizens' registration office of your main or only place of residence.

The registration, passport and ID card department of the citizens' registration office of the state capital Dresden is responsible for submitting, checking and deciding on your application.

The information block only applies for the purpose for which it was requested. The information block at the request of the person(s) concerned applies to non-public bodies (e.g. banks, insurance companies, company inquiries, inquiries from private individuals, etc.). As a result, the disclosure of your data in the form of information from the civil register to non-public bodies is only possible after a hearing with you and after the interests of the registration office have been weighed up. You will be heard in the context of a hearing on each incoming request for information.

The registration authority is legally obligated to provide information to authorities and public bodies. A hearing/consultation does not take place.

If data has already been passed on by you to third parties and is used by them, the information block cannot take effect here. No liability is assumed for this.
