An overview of proceedings for the imposition of administrative fines

Regardless of whether you have received a parking ticket, speeding ticket or, for example, have not complied with the obligation to report a new address in time – the proceedings for the imposition of administrative fines is the same.

Cautions

If an administrative offence is considered to be minor, a cautionary fine between € 5 and € 55 can be charged.

This is then only effective if you agree and pay the warning fine on time and in full. The procedure is then closed without any further action.

Instalment payments are not possible for cautionary fines.

Hearing

If the violation is not minor, this is prosecuted with a fine starting at €60 and proceedings for the imposition of administrative fine will be initiated.

Administrative order imposing a fine

If an administrative order imposing a fine notice is issued, additional administration fees and expenses will be due.

Appeal

If the administrative order imposing a fine notice is withdrawn, written information will follow.

If the appeal cannot be remedied, the procedural documents will be submitted to the competent district court in Dresden via the public prosecutor's office.

The administration fine authority is no longer responsible for the further procedure once it has been handed over.

Minors and young people

If the fine imposed on minors or young people (up to the age of 21) is not paid, the administration fine authorities may petition the juvenile court to order educational measures instead of the fine (Section 98 Law on Administrative Offences – OWiG).
